The Georgia DDS will accept a plea of Nolo Contendere once ever 5 years. With that being said, the defendant must be charged with a misdemeanor possession of marijuana that is less than one ounce. He must also be over the age of 16 and not have any previous convictions or pleas of nolo contendere to any violations governed by O.C.G.A. 40-5-75 within the previous 5 years. Once accepted by the judge, he/she will order the defendant to attend and complete a DUI Alcohol or Drug Use Risk Reduction Program. If completed, the defendant will return his/her license upon a pending suspension of 120 days.
